1. Acceptance
By accessing or using cinematicbharat.com (the "Site") or purchasing any wallpaper from it, you agree to these Terms of Use. If you don't agree, please don't use the Site.
2. About us
Cinematic Bharat is operated from Australia. References to "we", "us", and "our" mean Cinematic Bharat. You can reach us through the contact page or at hello@cinematicbharat.com.
3. Eligibility
You must be at least 13 years old to use the Site, or older if your local laws require it. By using the Site, you confirm you have the legal capacity to enter into these Terms.
4. Intellectual property
All wallpapers, photographs, designs, copy, and content on the Site are owned by Cinematic Bharat or our contributing photographers. They are protected by copyright and other intellectual property laws.
The watermarked previews on the Site are for browsing only. They aren't yours to download, copy, mirror, or redistribute.
5. The license you receive when you buy
When you purchase a wallpaper, we grant you a non-exclusive, non-transferable, worldwide license to use that wallpaper:
- For personal, non-commercial purposes only
- On any device you personally own
- For the lifetime of the file
You may: set it as your wallpaper, print it for personal use, crop or colour-adjust for your own devices.
You may not: resell or redistribute the file, use it in commercial projects, claim it as your own work, post it publicly online, sublicense it, or train AI/ML models on it.
6. Purchases and payment
Prices are in US dollars and processed through Stripe. By purchasing, you authorise us to charge your payment method the amount displayed at checkout. Currency conversion (if any) is handled by your bank.
7. Refunds
Because wallpapers are delivered instantly as digital files, sales are final. The exception: if a file is corrupted or never reaches you, contact us within 30 days and we'll provide a replacement or refund.
8. Acceptable use
You agree not to:
- Reverse-engineer, decompile, or attempt to extract source files from the Site
- Bypass watermarks, paywalls, or other access controls
- Scrape, mirror, or systematically download Site content
- Use the Site for any unlawful purpose, or in any way that disrupts others' access to it
9. Disclaimers
The Site and its content are provided "as is" without warranty of any kind, express or implied. We make no guarantees about uptime, accuracy, or fitness for any particular purpose. Display colours may vary between devices.
10. Limitation of liability
To the maximum extent permitted by law, our total liability for any claim arising from your use of the Site or a purchase is limited to the amount you paid us in the 12 months before the claim. We aren't liable for indirect, incidental, consequential, or punitive damages.
Nothing in these Terms excludes any consumer guarantee or right you have under the Australian Consumer Law that cannot legally be excluded.
11. Changes to these Terms
We may update these terms occasionally. Material changes will be announced on the Site, and the "effective date" at the top of this page will be updated. Continued use after a change means you accept the updated terms.
12. Governing law
These Terms are governed by the laws of Queensland, Australia. Any dispute will be resolved in the courts of Queensland.
